1.1. This User Agreement (hereinafter referred to as the Agreement) applies to the «ProTanki» game website, located at www.protanki.com, and to all websites linked to www.protanki.com.
1.2. The website of the game «ProTanki» (hereinafter referred to as the Website) is the property of ProTanki.
1.3. This Agreement regulates the relationship between the Administration of the «ProTanki» game site (hereinafter the Site Administration) and the User of this Site.
1.4. Administration reserves the right to change, add or delete paragraphs of this Agreement at any time without notice to the User.
1.5. The continued use of the Site by User implies their acceptance of this Agreement and the amendments to this Agreement.
1.6. User is personally responsible for checking this Agreement for any changes in it.
2. DEFINITIONS OF TERMS
2.1 The terms listed below have the following meaning for the purpose of this Agreement:
2.1.1 «ProTanki» means the Game, located at the domain name www.protanki.com, which operates through an Internet resource and its associated services.
2.1.2 Website Administration - authorised employees of the Shop, acting on behalf of ProTanki.
2.1.3. Website User (hereinafter referred to as User) - a person having access to the Site via the Internet and using the Site.
2.1.4. Website Content (hereinafter referred to as Content) - protected results of intellectual activity, including texts of literary works, their titles, prefaces, annotations, articles, illustrations, covers, musical works with or without text, graphic, textual, photographic, derivative, composite and other works, user interfaces, visual interfaces, trademark names, logos, computer programs, databases, as well as design, structure, selection, coordination, appearance, general style and arrangement of this Website.
3. SUBJECT MATTER OF THE AGREEMENT
3.1 The subject of this Agreement is to provide the Site User with access to the Goods and Services contained on the Site.
3.1.1. The Site provides the User with the following types of services:
• access to electronic content on a free basis, with the right to purchase (download), view the content;
• access to search and navigation tools of the online shop;
• enabling the User to post messages, comments, reviews of Users, rating the content;
• access to information about Goods and information about the purchase of Goods on a free basis;
• other types of services provided on the pages.
3.1.2. This Agreement applies to all currently available (actually functioning) services of the Online Shop, as well as any subsequent modifications and additional services that appear in the future.
3.2. Access to the game is provided free of charge.
3.3. This Agreement is a public offer. By accessing the Site, the User is deemed to have accepted this Agreement.
3.4. The use of materials and services of the Site is governed by the existing legislation of the European Union and Ukraine.
4. RIGHTS AND OBLIGATIONS OF THE PARTIES
4.1 The Website Administration has the right:
4.1.1. Change the terms of use of the Website, as well as change the content of this Website. The amendments shall come into force upon the publication of the new edition of the Agreement on the Website.
4.1.2. Limit access to the Site in case of violation of the terms of this Agreement by the User.
4.2. User has the right to:
4.2.1. Access to use the Site after complying with the registration requirements.
4.2.2. Use all the services available on the Site, and purchase any Goods offered on the Site.
4.2.3. Use the Site only for the purposes and in the manner prescribed in the Agreement and not prohibited by the laws of the European Union and Ukraine.
4.3. The Website User undertakes:
4.3.1. Provide, upon request of the Site Administration, additional information relating directly to the services of this Site.
4.3.2. Observe the property and non-property rights of the authors and other copyright holders upon use of the Site.
4.3.3. To refrain from any actions that might be considered as disturbing the normal operation of the Website.
4.3.4. Do not use the Site to disseminate any confidential or proprietary information about individuals or legal entities, protected by the laws of the European Union or Ukraine.
4.3.5. Avoid doing anything that might breach the confidentiality of the information protected by the EU and Ukrainian legislation.
4.3.6. Do not use the Site for distribution of advertising information, unless it is approved by the Administration of the Site.
4.3.7. Do not use the services of the Shop's website with the purpose of:
• upload content that is illegal, violates any rights of third parties; advocates violence, cruelty, hatred and/or discrimination on racial, national, gender, religious, social grounds; contains false information and (or) insults to specific persons, organizations or authorities.
• inducement to commit unlawful actions as well as facilitation of persons whose actions are aimed at violating restrictions and prohibitions in force on the territory of the European Union and in the state of Ukraine.
• violation of the rights of minors and (or) causing any form of harm to them.
• infringements of the rights of minorities.
• misrepresenting oneself as another person or representative of an organisation and/or community without due authorization, including the employees of the Online Shop.
• misrepresenting the properties and characteristics of any Product from the catalogue of the Online Shop posted on the Website.
• inappropriate comparison of Goods, as well as forming a negative attitude towards persons who (do not) use certain Goods or judging such persons.
4.4 The User is forbidden:
4.4.1 Use any devices, programmes, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or monitor the content of this Game Site;
4.4.2 Disturb the proper functioning of the Website;
4.4.3 By any means circumvent the navigational structure of the Website to obtain or attempt to obtain any information, documents or materials through any means not specifically provided through the services of this Website;
4.4.4. Unauthorised access to the functions of the Site, any other systems or networks related to the Site, and any services offered on the Site;
4.4.4 Violate the security or authentication system of the Site or any network linked to the Site.
4.4.5 Perform backtracking searches, trace or attempt to trace any information about any other User of the Site.
4.4.6. Use the Site and its Contents for any purposes prohibited by the laws of the European Union and Ukraine, as well as to incite any illegal activity or other activity that violates the rights of the Online Shop or other persons.
5. USE OF THE WEBSITE TO PURCHASE IN-GAME CURRENCY
5.1. The Site and the Content included on the Site are owned and operated by the Site Administration.
5.2. The Site's Contents may not be copied, published, reproduced, transmitted or distributed in any way, or posted on the global «Internet» without the prior written consent of the Site Administration.
5.3. The purchase of Crystals (in-game currency) offered on the Site may require the creation of the User's account.
5.4 The User is personally responsible for maintaining the confidentiality of the account information, including the password, as well as for all activities conducted on behalf of the User of the account without exception.
5.5 The User shall immediately notify the Administration of any unauthorised use of his/her account or password, or any other breach of security.
5.6. The Administration has the right to unilaterally annul the User's account, if it has not been used for over 5 consecutive calendar months without notice to the User.
5.7. This Agreement applies to all additional terms and conditions for the purchase of Goods and provision of services provided on the Website.
